Mary Angilly Dog Training LLC Waiver and Release

ASSUMPTION OF RISK. The undersigned (“you” or “Participant”) acknowledges that he/she is voluntarily participating in dog training provided by MARY ANGILLY DOG TRAINING LLC with knowledge of the potential dangers. Participant represents that he/she is the owner or guardian of the dog(s) identified in this Agreement. You acknowledge that dogs are unpredictable animals with their own will and drives, and therefore, regardless of training, handling, or environmental circumstance, MARY ANGILLY DOG TRAINING LLC cannot protect against every potential injury, risk or accident to you, to other persons participating in the training or on the property where the training is taking place, or to dogs. These may include dog attacks, dog bites and the responsive actions and complications that arise from them, and you understand and acknowledge that such risks are inherent and cannot be eliminated. This Agreement is intended to shift the risk of participating in dog training to you. Do not sign it unless you are willing to assume the risk to yourself, your dog, and others accompanying you of your participation in dog training, including the associated risks of bodily injury, death or property damage while participating in the dog training and related activities on the property of MARY ANGILLY DOG TRAINING LLC, in your own home, or in a public space.

RELEASE OF LIABILITY. Participant agrees that in consideration for being permitted to participate in dog training provided by MARY ANGILLY DOG TRAINING LLC, and/or to use any of MARY ANGILLY DOG TRAINING LLC’s facilities in connection with dog training, Participant, for himself/herself, and his/her heirs, next of kin, executors, and personal representatives (collectively, “Releasors”), assumes the entire risk associated with participating such an activity and waives, releases, discharges and covenants not to sue MARY ANGILLY DOG TRAINING LLC, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers or other representatives, their successors and/or assigns (collectively, “Releasees”), from any and all liability to Releasors for any loss, harm, damage, claim, injury (including death) or accident to the person or property of Participant, Participant’s dog, and any other persons accompanying Participant at the dog training, including any minor children, arising out of or related to participating in dog training or using any facilities or equipment of MARY ANGILLY DOG TRAINING LLC, even if caused by any negligent act or omission of Releasees. Nothing herein is intended to release Releasees from any harm, injury, claim or damage caused by intentional, wanton or reckless misconduct.

INDEMNIFICATION. You agree that you are and will be responsible for your conduct and the conduct of your dog and others accompanying you (including minor children) at all times. You agree to indemnify and hold harmless MARY ANGILLY DOG TRAINING LLC, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers and other representatives (“MARY ANGILLY DOG TRAINING LLC Personnel”), from any and all claims of injury (including death), loss, cost, expenses, or damage to persons, dogs, or property caused by the acts or omissions of you, your dog, and any other persons accompanying you, including any minor children, during the course of training or related activities, as well as by the conduct of your dog under your own care as a result of following training instructions. This provision applies whether the claims are made by you, members of your family, your accompanying guests, MARY ANGILLY DOG TRAINING LLC Personnel, or third parties.

NO GUARANTY OF RESULTS. You recognize that the role you play in your dog’s learning process is integral to achieving desired results. You acknowledge and agree that there is no guaranty that your dog will achieve the desired level of training, despite the best efforts of MARY ANGILLY DOG TRAINING LLC. You further understand that the recommendation of any other product or service by MARY ANGILLY DOG TRAINING LLC is not a guaranty of satisfaction with that product or service.

PHOTO RELEASE. By signing below, you give MARY ANGILLY DOG TRAINING LLC permission to publish in print, electronic, or video format the likeness or image of you and/or your dog. You release all claims against MARY ANGILLY LLC with respect to privacy rights, publicity rights, copyright ownership and publication, including any claim for compensation related to use of the materials.

CANCELLATION & REFUND POLICY. Participant may reschedule or cancel any session when providing over 48 hours of advance notice. Within 48 hours, participant will be billed in full and payment is forfeited for cancellations, reschedules, and no shows. No credits or refunds will be granted for no shows or cancellations with less than 48 hours of notice. Cancellations for emergencies will be handled on a case-by-case basis. Packages are nonrefundable and sessions must be fully scheduled within three months of purchasing.

INCLEMENT WEATHER. If inclement weather occurs and Trainer cannot safely travel to session, in-person sessions will automatically convert to Zoom. Notice will be given via email if this change is to be made. Cancellations/reschedules are not permitted with less than 48 hours of notice due to the nature of how far clients are booked out for sessions.

ILLNESS / COMMUNICABLE DISEASES. Participant agrees not to attend an in-person session if Participant or any person who will be present during the session is experiencing symptoms of a contagious illness or has been advised to isolate or avoid contact with others due to a communicable disease. Participant agrees to promptly notify Trainer if Participant or a household member is experiencing a contagious illness or has reason to believe they may expose Trainer to a communicable disease. Trainer reserves the right to convert an in-person session to a virtual session, require an outdoor session, reschedule a session, or terminate a session if Trainer reasonably believes that Participant or another person present may pose a risk of transmitting a communicable illness. Trainer will make reasonable efforts to provide notice when circumstances permit. Participant acknowledges that participation in in-person services carries an inherent risk of exposure to communicable illnesses and voluntarily assumes that risk to the extent permitted by applicable law.

TERMINATION OF SERVICES / CLIENT CONDUCT. Trainer reserves the right to refuse, suspend, or terminate services with any Participant at any time, at Trainer’s sole discretion, including, but not limited to, circumstances in which Trainer determines that continuing the professional relationship is no longer appropriate, productive, safe, or in the best interests of the Participant, the dog, Trainer, or any other person or animal. Reasons for termination may include, but are not limited to:

Participant repeatedly fails to follow reasonable training, management, safety, or handling recommendations provided by Trainer;
Participant fails to disclose information that Trainer reasonably believes is relevant to the safety or welfare of the dog, Participant, Trainer, or others;
Participant engages in conduct that is disrespectful, threatening, abusive, discriminatory, harassing, or otherwise inappropriate toward Trainer, Trainer’s representatives, or any other person or animal;
Participant uses physical force, punishment, intimidation, or equipment or techniques that are inconsistent with Trainer’s stated training philosophy;
Participant knowingly places the dog, Trainer, another person, or another animal in an unsafe situation;
Participant repeatedly fails to comply with agreed-upon management or safety protocols, particularly in cases involving aggression, reactivity, fear, or other behavior concerns;
Participant repeatedly cancels, reschedules, misses, or fails to attend scheduled sessions in a manner that interferes with the provision of services;
Participant fails to make required payments or otherwise breaches the terms of this Agreement; or
Trainer determines, in her professional judgment, that the Trainer–Participant relationship is no longer a good fit or that Trainer is not the appropriate professional to provide the requested services.

Trainer may terminate services immediately when Trainer determines that continued services present a safety concern or that immediate termination is otherwise warranted. In other circumstances, Trainer may provide notice of termination at her discretion. Termination of services does not relieve Participant of the obligation to pay for services already provided, fees already incurred, or cancellation fees otherwise due under this Agreement. Except where otherwise required by applicable law or expressly agreed to by Trainer in writing, unused portions of prepaid packages are nonrefundable upon termination by Trainer. Where reasonably appropriate, Trainer may provide recommendations for alternative professional resources following termination; however, Trainer does not guarantee the availability, suitability, or acceptance of any referral.

SAVINGS CLAUSE. You expressly agree that the foregoing assumption of risk, release, waiver, and indemnity provisions are intended to be as broad and inclusive as permitted by applicable law, and that if any portion thereof is held invalid, you agree that the remaining provisions will continue in full force and effect.

KNOWING AND VOLUNTARY EXECUTION. By signing the New Client Questionnaire, you declare that you are at least 18 years of age and competent to sign this Agreement. You acknowledge that you have carefully read this Agreement, understand its contents, and agree to be bound by its terms. You specifically understand that this Agreement includes an assumption of the risk of MARY ANGILLY DOG TRAINING LLC’s negligence and a release of MARY ANGILLY DOG TRAINING LLC’s liability.
